1. General provisions

1.1. The rules of this online store (hereinafter – the Rules) are a legally binding document for the Buyer and the Seller, which determine the rights and obligations of the Parties.

1.2. The Seller reserves the right to change, amend or supplement these Rules at any time. The Buyer is informed about changes in the Rules on the website of the e-store.

2. Conclusion of the purchase contract

2.1. The purchase-sale contract between the Buyer and the Seller is considered concluded from the moment when the Buyer, after choosing the item(s) to be purchased and creating a shopping cart, clicks on the “Pay” link.

2.2 An account in the Online Store is created automatically. The buyer has the opportunity to view the purchase history after connecting to the Online Store system.

2.3. Each purchase-sale contract concluded between the Buyer and the Seller is registered and stored in the database of the online store www.litpolstar.lt.

3. Obligations of the buyer

3.1. The buyer is responsible for the correctness of the data provided in the registration form. If the Buyer does not provide accurate or complete data in the registration form, or incorrect data is provided, all related risk and responsibility rests with the Buyer. The buyer is also responsible for updating his data in the registration form if they change.

3.2. The buyer undertakes to pay for the goods in accordance with the procedure established by these Rules. When paying for the goods, the buyer is obliged to indicate the correct data required for the payment in one of the ways permitted by these Rules. The buyer assumes full responsibility for specifying incorrect data.

3.3. The buyer undertakes to accept the goods in accordance with the procedure established by these Rules. If the Buyer, during the delivery of the goods, refuses to accept the goods without good reasons, the Buyer must cover the costs of returning the goods at the Seller’s request.

3.4. The buyer, using the www.litpolstar.lt online store, undertakes to comply with these Rules and other conditions clearly indicated in the online store and not to violate the laws of the Republic of Lithuania.

4. Buyer’s rights

4.1. The buyer has the right to buy goods in the www.litpolstar.lt online store in accordance with the procedure established by these Rules and the online store.

4.2. The buyer has the right to refuse the goods purchase – sale contract by notifying the seller in writing (by email, indicating the desired item to be returned and its order number).

4.3. The buyer can exercise the right to refuse the contract of sale of goods only if the goods have not been damaged or their appearance has not changed substantially, and they have not been used.

4.4. The return and exchange of goods is carried out in accordance with the 2014 Regulation of the Government of the Republic of Lithuania. July 22 by resolution no. 738 “On the Government of the Republic of Lithuania in 2001 June 11 resolution no. 697 “On approval of retail trade rules” amendment and the procedure established in Articles 6.22810 and 6.22811 of the Civil Code.

5. Obligations of the seller

5.1. The Seller undertakes to provide the Buyer with the opportunity to use the services provided by the online store www.litpolstar.lt under the conditions set out in these Rules and the online store.

5.2. The Seller undertakes to respect the Buyer’s privacy right to his personal information, to process the personal data specified by the Buyer only in accordance with the Privacy Policy and the legal acts of the Republic of Lithuania.

5.3. The Seller undertakes to deliver the goods purchased by the Buyer to the address specified by the Buyer under the conditions provided for in these rules.

5.4. When, due to unforeseen circumstances, the Seller cannot deliver the goods ordered in the online store, the Seller has the right to terminate the Purchase-Sale Agreement after notifying the buyer beforehand. The seller can offer a similar product. If the buyer refuses, the seller undertakes to return the paid money within 3 working days.

5.5. After the buyer uses Rule 4.2. the right provided for in point 4.4 of the Rules. clause, the Seller undertakes to return the money paid to the Buyer within 14 (fourteen) working days, counted from the day of receipt of the returned goods.

5.6. The Seller may not return the amount of money paid to the Buyer until the goods are returned to the Seller.

6. Seller’s Rights

6.1. If the Buyer tries to harm the stability and security of the online store or violates his obligations, the Seller has the right to immediately and without warning limit or suspend his access to the online store or, in exceptional cases, cancel the Buyer’s registration.

6.2. In the event of important circumstances, the Seller may temporarily or completely terminate the online store without notifying the Buyer in advance.

6.3. The Seller has the right to cancel his order without prior notice to the Buyer and unilaterally terminate the purchase-sale agreement, if the Buyer does not pay for the goods in any manner permitted by these Rules within 3 (three) working days from the conclusion of the purchase-sale agreement.

7. Product prices, payment procedure and terms

7.1. The prices of goods in the online store are indicated in euros. Prices include VAT. After confirmation of the order, the delivery fee, if applicable, is added to the total amount of the goods.

7.2. The buyer has the right to pay for the selected goods in one of the following ways:

7.2.1. Payment using electronic banking means payment by transferring money to the Buyer using the electronic banking system of his choice. In order to use this form of payment, the Buyer must have signed an electronic banking agreement with one of the banks indicated by the Seller. When paying for goods in this way, a payment is generated for the Buyer in the electronic banking system according to the order paid by him;

7.2.2. Payment by bank transfer is an advance payment, when the Buyer transfers money in advance to the www.litpolstar.lt bank account in any bank branch;

7.2.3. Payment with a debit/credit payment card is an advance payment, when the Buyer transfers money from the card account to the www.litpolstar.lt bank account in advance.

7.3. After paying for the goods by the method chosen by the buyer, e-store representatives confirm the order and send a letter to the email specified by the Buyer. informing about it by mail. The delivery time starts from the order confirmation letter.

8. Delivery of goods

8.1. When ordering goods, the buyer can choose the method of delivery of the goods, i.e. use the goods delivery service provided by the Seller or pick up the Seller’s goods in the store.

8.2. Delivery of goods to the Buyer:

8.2.1. The buyer, who has chosen the delivery service during the order, undertakes to indicate the exact place of delivery of the goods;

8.2.2. The buyer undertakes to personally accept the goods at the specified place of delivery. In the event that he himself cannot receive the goods at the specified place of delivery, but the goods were delivered to the specified address, it is considered that the Goods were delivered correctly, and the Buyer has no right to make claims to the Seller due to improper delivery of the goods;

8.2.3. The goods are delivered by the Seller or his authorized representative.

8.3. Collection of goods at the collection point specified by the Seller:

8.3.1. The Buyer can pick up the goods free of charge from the Seller’s order pick-up location, with prior arrangement by phone or e-mail;

8.3.2. The ordered goods must be picked up no later than within 5 (five) working days, counted from the moment of receipt of the Seller’s confirmation that the order is ready.

8.4. The Seller provides the goods to the Buyer in accordance with the terms specified in the product descriptions. These terms are preliminary and do not apply in cases where the Seller does not have the required goods in stock and the Buyer is informed of the shortage of the goods ordered by him.

8.5. Delivery of goods may be delayed due to special circumstances. In this case, the Seller undertakes to immediately contact the Buyer and coordinate the order of delivery of the goods.

8.6. In all cases, the Seller is released from responsibility for the violation of the deadlines for the delivery of the goods, if the goods are not delivered to the Buyer or are delivered late due to the fault of the Buyer or due to circumstances beyond the control of the Buyer.

9. Product warranty period, exchange, return

9.1. The products are not subject to any special warranty period.

9.2. The characteristics of all goods sold are indicated in the description attached to each item. The seller is not responsible for the fact that the color, shape or other parameters of the goods in the online store may not correspond to the real size, shape and color of the goods due to the characteristics of the monitor used by the Buyer.

9.3. Quality goods can be returned within 14 days of receipt. Defects of sold low-quality goods are eliminated, low-quality goods are exchanged, and returned in accordance with the provisions of the Civil Code of the Republic of Lithuania.

9.4. The following conditions must be met when returning goods:

9.4.1. The returned item must be in its original, neat packaging (this clause does not apply in the case of returning a defective item);

9.4.2. The product must be undamaged by the Buyer;

9.4.3. The product must be unused, without losing its commercial appearance: intact label, untorn protective film, etc. (this clause does not apply in case of returning a defective product);

9.4.4. The returned item must be in the same package as the one received by the Buyer.

9.5. The Seller has the right to refuse to accept the goods returned by the Buyer if the conditions for returning the goods were not met.

10. Marketing measures applied by the seller

10.1. The Buyer, who does not want his email address and phone number to be processed for the purpose of direct marketing, must inform the Seller about this by sending a message to info@litpolstar.lt from the e-mail address specified by the Buyer.

10.2. Seller email in the store www.litpolstar.lt can initiate various promotions at its own discretion.

10.3. The seller has the right to unilaterally, without separate notice, change the conditions of the shares and terminate them. Nevertheless, even after the termination of the promotions, the obligations arising between the Seller and the Buyer during the purchase and sale of goods remain.

11. Exchange of information

11.1. The Seller sends all notifications to the Buyer to the e-mail address provided in the Buyer’s registration form.

11.2. The buyer sends all messages and questions to the seller to the e-mail address info@litpolstar.lt.

12. Final Provisions

12.1. These terms and conditions of purchase are drawn up in accordance with the legal acts of the Republic of Lithuania.

12.2. Relations arising on the basis of these rules shall be governed by the law of the Republic of Lithuania.

12.3. All disagreements arising from the implementation of these Rules shall be resolved through negotiations. If an agreement cannot be reached, disputes are resolved in accordance with the procedure established by the laws of the Republic of Lithuania.
